語源
「aquilia」はラテン語に由来し、氏族名「Aquilius」（または「Aquila」に関連）から来ている。「Aquila」は「鷲（ワシ）」を意味し、氏族名が法名の由来となった。
「aquilia」は古典ラテン語で法名「Lex Aquilia」として成立し（Aquilius氏族の提出法に由来）、中世や法律ラテン語でも用いられ、英語の法制史語としても借用されて現在に至る。
当初はAquiliusに由来する特定の法を指したが、次第に不法損害やそれに対する救済（Aquilian action）という広い法概念を表す語へと発展した。
