語源
「bailment」は古フランス語の動詞「baillier／bailler」（『引き渡す』『手渡す』の意）に由来し、名詞化接尾辞「-ment」と結合して成立した語です。
中英語（例：'baillement'）を経て英語に取り入れられ、『bail』（古フランス語由来）に接尾辞『-ment』がついて名詞化され、現代の法用語『bailment』になりました。
当初は『引き渡す行為』という広い意味でしたが、次第に法的用法で『物品の預託および占有のみが移る関係』という限定的な意味に変化しました。
