『aubain』は古フランス語（『aubaine』『aubain』とも）に由来し、外国人や国家が外国人の財産を主張する概念を表した。
『aubain』は古フランス語で使われ、中英語の法的・行政的記録にも同じ綴りで入った。やがて日常英語では稀になったが、法史的文脈では残った（しばしば「droit d'aubaine」に言及）。
