『litigate』はラテン語『litigāre』に由来し，語根の『lit-』（『lis, litis』から）は「訴訟・争い」を意味した。
『litigate』はラテン語『litigāre』から古フランス語の『litiger』などを経て，中英語の『litigaten』となり，最終的に現代英語の『litigate』になった。
当初は「争う・口論する・訴訟を行う」を意味していたが，時代を経て現在の「正式な訴訟を行う／法廷で争う」という法的な意味に限定されてきた。
